Terms of use

In short: DeskTransfer is free and is provided as it is, without any guarantee.
You use it at your own risk and you are responsible for your files and for keeping backups. As far as the law allows, we are not liable for loss or damage that comes from using it.
1. What these terms are
These terms are the agreement between you and DeskTransfer ("we", "us"), the developer of the DeskTransfer app for Android and the DeskTransfer program for Windows (together "DeskTransfer"). By installing or using DeskTransfer you accept them. If you do not accept them, do not install or use DeskTransfer.
2. What you may do
- You may install and use DeskTransfer free of charge, on devices you own or are allowed to use, for private or business purposes.
- You may not sell DeskTransfer, pass it off as your own, or distribute a changed version under the DeskTransfer name.
- You may not use DeskTransfer to break the law, to reach devices or files you have no right to reach, or to harm others.
- DeskTransfer contains open-source software. Those parts stay under their own licences, which are listed in the app and on our website, and nothing in these terms limits the rights those licences give you.
The name DeskTransfer, its logo and its design remain ours.
3. How DeskTransfer works, and what that means for you
DeskTransfer moves files, apps, notes, links and messages directly between your own devices, over your own network. We run no servers for it and we cannot see, store, restore or recover anything you send or keep with it.
This means that you, and not we, are responsible for:
- Your files. DeskTransfer can copy, move, rename, convert and delete files on your phone and your PC. Keep your own backups of anything you cannot afford to lose.
- What you send and install. You decide which files and app files you transfer, open and install, and you must have the right to do so.
- Who is linked. Link only devices you own or trust, keep the pairing code to yourself, and remove a device you no longer use. A linked device can reach what you allow it to reach, including all files on the PC if you turn that setting on.
- Your devices and your network. You are responsible for the security of your phone, your PC, your Wi-Fi and any private network you use to reach your PC from outside your home.
4. Services of others
DeskTransfer can be used together with services we do not run and do not control, for example Tailscale, Google Play, Android and Windows. Their own terms and privacy policies apply to them, and we are not responsible for them.
5. No guarantee
DeskTransfer is provided "as is" and "as available". As far as the law allows, we give no guarantee of any kind, whether stated or implied: not that it is free of errors, not that it will work without interruption or on every device, not that a transfer or conversion will succeed or give a certain result, and not that it is fit for a particular purpose.
We may change DeskTransfer, remove functions, or stop offering or updating it at any time, without notice.
6. Limit of our liability
As far as the law allows:
- we are not liable for lost, damaged or deleted files or data, for lost profit, income or business, for interruption of your work, or for any indirect or consequential loss;
- we are not liable for loss or damage caused by how you use DeskTransfer, by a device you linked, by files or apps you transferred or installed, or by the services of others;
- our total liability to you for everything connected with DeskTransfer is limited to the amount you paid us for it in the twelve months before the claim. DeskTransfer is free, so that amount is zero.
Nothing in these terms limits liability that cannot be limited by law, such as liability for damage we cause on purpose or by gross negligence, or liability under mandatory product liability rules. If you are a consumer, these terms do not take away rights that the mandatory law of the country you live in gives you.
7. Your privacy
DeskTransfer collects nothing about you. The details are in the Privacy Policy.
8. End of these terms
You can stop at any time by uninstalling DeskTransfer from your devices. Your right to use DeskTransfer ends if you break these terms. Sections 5, 6 and 10 continue to apply afterwards.
9. Changes to these terms
We may change these terms. The new version is published at the same place with a new date, and applies from then on to your further use of DeskTransfer.
10. Law and disputes
These terms are governed by the law of Denmark. Disputes are decided by the courts of Denmark. If you are a consumer living in another country, you keep the protection of the mandatory rules of that country and may bring a case before the courts there.
If a part of these terms turns out to be invalid, the rest stays in force.
